The recent Supreme Court decision regarding the modulation of the collection of union dues restores legal certainty in labor relations and ends the period of intense uncertainty that affected companies and unions since the change in understanding in 2023. By prohibiting retroactive collection, the Court avoids the formation of unpredictable liabilities and guarantees predictability for business planning, without precluding the possibility of future union funding within constitutional limits.
